Damian Bugg DPP statement here: https://www.cdpp.gov.au/Media/Releases/20050728mr.aspx
(From ABC Radio’s PM)JEREMY COOPER: We did not drop any charges against Vizard as part of
negotiations we had with his lawyers. Nor did we agree to drop criminal
if he admitted to civil. I also want to make it absolutely clear
that if criminal charges had been available, we would have brought
them. ASIC believes that Mr Vizard’s actions were serious – a
deliberate breach of trust – and should attract penalties at the high
end of the scale. And we said this justified a banning of between seven
and 12 years.
(From the Herald Sun)
He cited the reluctance of a key witness – believed to be
accountant Greg Lay – to sign a voluntary witness statement as the
main problem with bringing criminal charges.
